Prior to the bidding of concession projects or of public-private partnerships, the Public Sector Contracts Law establishes the need to undertake a feasibility study to determine: the purpose and justification of the contract; provisions regarding its demand for usage and the economic and social impact of the contract in its area of influence and the profitability of the concession; and the cost of investment to be made and the proposed system of financing. Subsequently, and in light of circumstances that may arise during the contracts’ development period, new evaluations of feasibility and economic equilibrium will be required in accordance to the mentioned Law.
